By submitting any payment, whether in the form of a deposit, invoice payment, or any other type of monetary transaction, to Concept Vision Technology LLC ("Company"), or by signing any agreement or contract with the Company, you are hereby acknowledging and agreeing that you are entering into a legally binding client relationship with the Company. Furthermore, by doing so, you expressly accept and agree to be bound by the terms and conditions outlined in this document ("Terms"). This acceptance applies regardless of the form or method of payment and extends to any subsequent transactions or agreements between the parties. By initiating any form of business transaction with the Company, you affirm that you have read, understood, and consented to these Terms in their entirety.

2. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any significant changes by posting the new Terms on our website and updating the effective date. Your continued use of the services after the posting of changes constitutes your acceptance of such changes.

3. Use of Services

3.1. Eligibility

You must be at least 18 years old to use our services. By using our services, you represent and warrant that you meet this age requirement.

3.2. Account Registration

To access certain features of our services, you may need to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account.

4. Orders and Payments

4.1. Pricing

All prices are listed in USD unless otherwise specified. We reserve the right to change prices at any time without prior notice.

4.2. Payments

Payment for products and services must be made through the payment methods available on our website. By providing payment information, you represent and warrant that you are authorized to use the designated payment method and that you authorize us to charge your payment method for the total amount of your order.

4.3. Order Acceptance

We reserve the right to refuse or cancel any order at any time for any reason, including but not limited to product availability, errors in the description or price of the product, or errors in your order.

4.3. Deposits and Deposits Fee

From time to time, we may require the payment of a deposit fee ("Deposit") in connection with the reservation of services. The Deposit serves as a non-refundable payment to secure your place in our service queue in situations where the commencement of services is delayed at your request. Additionally, the Deposit may be applied as a cancellation fee in the event you fail to adhere to the terms of the service agreement or cancel. The Deposit will remain valid for a period of two (2) years from the date of payment, after which time, if services have not commenced, the Deposit will be forfeited. By making any payments to the Company, you acknowledge and accept that the Deposit is non-refundable unless otherwise stipulated in a separate written agreement.

5. Fulfillment Policy

5.1. Order Processing

Once an order is placed and payment is confirmed, you will receive an email notification acknowledging your purchase. This email will contain details of the product(s) purchased and the estimated delivery timeline.

Our team will review your order to ensure that all necessary information is provided and that the order is complete. If additional information is required, we will contact you via the email address provided.

5.2. Delivery

5.2.1. Product Delivery

Most of our products need to be built out and developed so the delivery needs to fit the date given on the agreement.

5.2.2. Email Delivery

In some cases, digital products may be delivered via email within 24 hours of purchase. This will include a direct download link or instructions on how to access the product.

5.2.3. Account Access

For software or services that require account creation, you will receive an email with instructions on how to access your account and the associated product. Account setup emails are typically sent within 24 hours of purchase.

5.3. Custom Software Development

5.3.1. Project Initiation

Upon receiving an order for custom software development, our team will schedule an initial consultation to understand your requirements and project scope. This will typically occur within 48 hours of order confirmation.

5.3.2. Development Phases

Custom software development projects are divided into 3-4 phases. Each phase will have specific deliverables and a timeline, which will be communicated to the client at the beginning of the project.

5.3.3. Delivery and Deployment

Each phase will be delivered according to the agreed-upon timeline. The final product will be delivered via secure digital transfer or other agreed-upon methods after thorough testing and client approval.

5.4. Revisions and Support

5.4.1. Revisions

We offer a revision period for each phase of the custom software project to address any necessary changes or adjustments. The terms and duration of this period will be outlined in the project agreement.

5.4.2. Technical Support

For digital products and custom software, we provide technical support to assist with any issues or questions. Support is available via email or our support portal, and response times are typically within 24 hours.6. Refunds and Cancellations

6.1. Digital Products

Due to the nature of digital products, all sales for Softify Camp are final and non-refundable. By purchasing our course, you confirm that you have reviewed the product descriptions and system requirements and are making an informed decision. We are a company focused solely on teaching Bubble as a no-code technology. Our mission is to empower individuals with the skills and knowledge to build apps, not to promote or encourage any type of get-rich-quick scheme, investment opportunity, or MLM (multi-level marketing) schemes. We are not involved in any financial ventures, and our goal is purely to teach a valuable, marketable skill.Once you gain access to our digital course, you will have everything you need to learn and apply Bubble. We cannot offer refunds if a participant chooses to disengage from the course or completes it and then requests a refund. Your success relies on your commitment to learning, and we can only guarantee our best efforts to teach you the technology, not specific results.

Refund Eligibility Requirements

To be eligible for any refund consideration, you must have been an active participant in Softify Camp for a minimum of six months. Active participation includes completing course material, engaging in assignments, attending 80% of weekly meetings and participating in community discussions or support activities. Any refund requests made prior to this six-month period will not be eligible for review. We believe that learning Bubble is a long-term commitment, and we want to ensure you have sufficient time to fully engage with the course content before evaluating its value.However, if at any point after the six-month active period you feel that our team has not put forth 100% effort or failed to provide the best possible teaching experience, and you can provide clear, documented proof of this failure, we are willing to review your case. Should it be determined that we did not fulfill our commitment to teaching with the highest standards, we will issue a refund.By purchasing our product, you accept these terms and agree that refunds will only be considered under the specific conditions outlined above. Your engagement and willingness to learn are key to your success, and we are here to support you in that journey.

6.2. Custom Software Development

Payments for each phase of custom software development are non-refundable once that phase has commenced. However, if we fail to deliver the promised deliverables for any phase, a refund will be issued for that specific phase. Refund requests must be submitted in writing and will be reviewed within 14 business days.

7. Intellectual Property

7.1. Ownership

All content, including but not limited to text, graphics, logos, and software, is the property of Softify or its licensors and is protected by intellectual property laws. You may not use, reproduce, modify, or distribute any content without our prior written consent.

7.2. Trademarks

"Softify" and "Concept Vision Technology LLC" and any related logos are trademarks of Concept Vision Technology LLC. You may not use these trademarks without our prior written permission.

8. Limitation of Liability

8.1. Disclaimer

Our services are provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, error-free, or free of viruses or other harmful components.

8.2. Limitation of Liability

In no event shall Softify or Concept Vision Technology LLC be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use our services; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from our services; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our services by any third party; (v) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through our services; and/or (vi) the defamatory, offensive, or illegal conduct of any third party. In no event shall Softify or Concept Vision Technology LLC's total liability to you for all claims exceed the amount paid by you to us in the twelve (12) months preceding the event giving rise to the claim.9. IndemnificationYou agree to indemnify, defend, and hold harmless Softify and Concept Vision Technology LLC, its officers, directors, employees, agents, and affiliates, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of our services or your violation of these Terms.10. Governing LawThese Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located within the State of Wyoming to resolve any legal matter arising from these Terms.

11. Dispute Resolution

11.1. Informal Resolution

Before filing a claim against us, you agree to attempt to resolve the dispute informally by contacting us at team@softify.com. We will attempt to resolve the dispute informally by contacting you via email. If a dispute is not resolved within 30 days of submission, you or Softify may bring a formal proceeding.

11.2. Arbitration

Any dispute arising out of or relating to these Terms or our services shall be finally resolved by binding arbitration administered by the American Arbitration Association (AAA) under the Commercial Arbitration Rules. The arbitration will be conducted in Sheridan, Wyoming, and judgment on the arbitration award may be entered in any court having jurisdiction.

12. Miscellaneous

12.1. Entire Agreement

These Terms constitute the entire agreement between you and Softify regarding the use of our services and supersede any prior agreements between you and Softify relating to your use of our services.

12.2. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

12.3. Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and Softify's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.13.
